向工业废水集中处理设施排放污染物的，由工业废水集中处理设施的运营单位申请领取排污许可证，除按前款规定提交资料外，还应提交向工业废水集中处理设施排放污染物的排污者营业执照、污染物委托处理协议等资料。 第十条（新项目申请时间）
建设单位应当在新建项目的主要环保设施和措施已与主体工程同时建成和落实，并经环保行政主管部门现场核实同意进入试生产后，填报临时排污许可证申请表，申请临时排污许可证。通过环保验收的，应在收到验收合格文件之日起10个工作日内提交第八条第(二)款规定的资料，填报排污许可证申请表，申请排污许可证。
排污者应当在改建、扩建和技术改造项目投入试生产前填报排污许可证变更申请表，申请变更排污许可证载明事项。 第十一条（申请受理）

负责审批的环境保护行政主管部门对新建项目的排污者，符合规定条件的颁发排污许可证，否则不予发证；对现有排污者符合规定条件的，颁发排污许可证。对未达到第九条第一款第（一）、（五）、（七）项规定条件的，不予发证；对未达到第九条第一款第（二）、（三）、（四）、（六）项规定条件，且污染物超标排放的，颁发临时排污许可证，并责令限期整改。
整改期限届满前30日内，排污者应向环境保护行政主管部门报告整改完成情况，申请领取排污许可证。对达到整改要求的，由有审批权的环境保护行政主管部门颁发排污许可证；逾期未完成整改任务的，不予颁发排污许可证，临时排污许可证自行失效。 第十四条（分级审批制度）
国家对排污许可证实行分级审批颁发制度。
县级以上地方人民政府环境保护行政主管部门应当按照国务院环境保护行政主管部门或各省、自治区、直辖市人民政府环境保护行政主管部门规定的审批权限对排污者的排污许可证审批颁发。
县级环境保护行政主管部门负责行政区划范围内排污者的排污许可证审批颁发。 市级环境保护行政主管部门负责本行政区域内确定由其监督管理排污者的排污许可证审批颁发。

第五十二条（分阶段实施计划）
各省、自治区、直辖市环境保护行政主管部门根据国务院和省、自治区、直辖市人民政府环境保护目标，结合本行政区环境质量状况和变化趋势以及社会、经济、技术条件，可以制定分期分批实施排污许可证的计划，并予以公告。
符合下列条件的排污者应当于本条例颁布之日起1年内，申请领取排污许可证： （一）国务院确定的重点流域、酸雨控制区、二氧化硫控制区内，设区的市级以上人民政府环境保护主管部门确定的重点污染源；
（二）城市(镇)污水处理厂、工业废水集中处理厂、生活垃圾处理厂；
（三）火电、石化、钢铁、有色、水泥、造纸、化工、酿造、印染等行业的生产企业。 前款以外的排污者应自本条例颁布之日起3年内申请领取排污许可证。
本条例施行前，已取得环境保护主管部门颁发的排污许可证的，应当在原许可证有效期届满30日前按本条例规定重新申请领取排污许可证。 第五十三条（豁免条款）

本条例自年月日起施行。国务院此前颁布的关于排污许可证的行政法规与本条例不一致的，以本条例为准。
